2. Data Controller vs. Data Processor

  • Clients as Data Controllers: You control how and why data is processed.
  • AccSeller8 as Data Processor: We act strictly on your instructions.
  • Your Responsibility: You must ensure a legal basis exists for data use and indemnify us against any misuse or non-compliance.

3. Data We Collect

  • Client Account Data: Name, email, business info, contact details, billing.
  • End-User Data (on your behalf):
    • Voice call recordings and transcripts
    • SMS and email content
    • Contact details and lead qualification info
    • CRM data, IP address, device/browser info
  • Usage & Technical Data: Login history, access logs, support requests.

4. Legal Basis for Processing

  • Performance of Contract – To deliver requested services
  • Legitimate Interest – Quality control, analytics, fraud prevention
  • Consent – Required for marketing and user tracking

You must store and prove consent under GDPR, PECR, TCPA, CAN-SPAM, CASL, LGPD, PDPA, POPIA.

5. How We Use Data

  • Delivering AI call, SMS, and email services
  • CRM syncing, reporting, and analytics
  • Client onboarding, account support
  • Security, fraud detection, legal compliance

6. Data Sharing

We never sell your data. We share it with:

  • Telephony, CRM, and AI infrastructure partners
  • Trusted subprocessors under DPA/SCC contracts
  • Payment providers (e.g., Stripe, PayPal)
  • Law enforcement or regulators, if legally required

7. International Transfers

  • We prefer UK/EU data residency when possible
  • We apply Standard Contractual Clauses (SCCs) to safeguard cross-border data flows

8. Data Retention

  • Call data: 90 days
  • Marketing data: 3 years or until consent is withdrawn
  • Account data: 7 years post-contract
  • Support & log files: Up to 12 months

9. Security

  • Encryption at rest and in transit (TLS, AES-256)
  • Access control, MFA, audit logging
  • Annual penetration testing and vulnerability scans

10. Data Subject Rights

  • Access, correction, deletion of personal data
  • Objection or restriction to processing
  • Data portability upon request

Requests must be sent to the Data Controller (you). We assist when required by law.

11. Children's Privacy

Our services are not intended for users under 16. Any data inadvertently collected will be deleted promptly upon discovery.

12. Data Breach Notification

  • We will notify you within 72 hours of a confirmed breach
  • You are responsible for notifying your end-users

13. Messaging & A2P Compliance

  • You must obtain valid opt-in consent before sending SMS or email
  • Include opt-out or unsubscribe in all outbound messages
  • Do not upload or send to scraped or unauthorized lists
  • Comply with regional laws on frequency, disclosure, and language

This policy may be updated. Material changes will be announced via platform notice or email.
