These Terms and Conditions constitute a legally binding agreement between you ("Client") and AccSeller8 ("Company," "we," "us," or "our") regarding your access and use of AccSeller8’s AI voice agent services, white-labeled dashboards, and related software.
By accessing our platform and services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use immediately.
AccSeller8 provides AI-powered voice agent services, including telephony, messaging, and CRM integrations.
Clients are Data Controllers, meaning they are responsible for ensuring that their use of AccSeller8’s services complies with applicable laws, including GDPR, PECR, and TCPA.
AccSeller8 is a Data Processor, meaning we process data solely on behalf of and under the instructions of our Clients.
This agreement constitutes a Data Processing Agreement (DPA) under GDPR and outlines all obligations relating to data protection, processing, and compliance.
Clients must establish a valid legal basis for processing customer data, including:
Performance of Contract: When AI services are essential for fulfilling a contractual obligation.Legitimate Interest: For service quality monitoring, fraud prevention, and analytics.Explicit Consent: Required for marketing calls, SMS, reviews, and testimonials.
Clients must provide proof of consent upon request.
AccSeller8 is not responsible for verifying consent; Clients take full responsibility.
Clients must obtain and store explicit consent before making AI-driven sales or marketing calls.
Clients must confirm that all leads provided are opt-in and comply with regional telephony regulations.
Clients agree to indemnify AccSeller8 against any claims or penalties resulting from unauthorized marketing.
If Client data is transferred outside the UK/EU, Standard Contractual Clauses (SCCs) must be in place.
Clients agree that any integrations with third-party APIs comply with data protection laws.
AccSeller8 will store personal data only for as long as necessary.
Clients must delete outdated or unnecessary data within their accounts.
AccSeller8 employs encryption and access controls to safeguard stored data.
AccSeller8 is not liable for:
Client’s failure to obtain legal consent.Unlawful use of AI voice services.Any regulatory penalties incurred due to non-compliance.
Clients assume full responsibility for ensuring compliance with all applicable laws.
AI-generated interactions may not always be accurate. Clients must review and monitor AI performance.
AccSeller8 does not accept liability for losses resulting from AI errors or misinterpretations.
Clients agree to defend, indemnify, and hold harmless AccSeller8 from any claims, penalties, or liabilities arising from:
Breach of data protection regulations.Misuse of AI voice technology.Unauthorized marketing or telephony practices.
AccSeller8 may suspend or terminate access without liability if a Client:
Fails to comply with legal requirements.Engages in spam, fraud, or non-compliant marketing practices.Breaches the terms of this agreement.
Clients must cease using AccSeller8’s services immediately upon termination and remove all customer data processed through our platform.
These Terms are governed by the laws of England and Wales.
Any disputes shall be resolved through binding arbitration, except where prohibited by law.
We reserve the right to modify these Terms at any time.
Clients will be notified of material changes via email or dashboard notifications.
